Abstract
The possibility of purging default at any time, as expanded in the previous wording of Article 39, item II, of Law 9,514/97, has sparked sufficient debate to the point that it is essential to establish a binding precedent – IRDR. This issue, which has not yet been settled, has been used as an argument to try to prevent the procedure for executing the guarantee. However, such an argument is logically unfeasible since only after the auction is there a purchase and, therefore, since it precedes, the sale cannot be prevented by the feasibility of carrying out an act that necessarily follows it.
