The article aimed to investigate fatphobia and its connection to food and social exclusion. It is noteworthy that obesity is a health condition that has become increasingly prevalent worldwide and is closely linked to issues of nutrition and fundamental rights. The constitutional treatment of fatphobia indicates the need for a multi-faceted protection that extends into economic, psychological, and social spheres. The process of constructing human dignity traverses the fields of health and legal protection, as the effectiveness of human protection will have a direct impact on human life in both physical and psychological aspects. From a methodological point of view, the investigation is characterized as a theoretical study grounded in bibliographic research. The interpretation of constitutional norms is used to discuss protection against fatphobia. To fulfill the objective of the chosen approach, the article was divided into stages that transition between constitutional hermeneutic analysis and the provision of food. Everyone has the right to food that meets their nutritional needs. This includes access to healthy and quality food. The constitutional approach to fatphobia suggests the need for protection that encompasses economic, psychological, and social aspects. The article suggests that addressing fatphobia and its consequences requires a comprehensive approach that includes the protection of fundamental rights, effective public policies, and a cultural change regarding the perception of obesity. The promotion of inclusive environments and equal access to resources and opportunities are essential for building a fairer and healthier society.
