INTERNATIONAL RECOGNITION OF HUMAN RIGHTS AND DIGNITY OF PERSONS DEPRIVED OF THEIR LIBERTY

The study addressed the critical issue of severe human rights violations and the dignity of persons deprived of liberty (PDL), exacerbated by overcrowding and resource shortages in penitentiary systems. The general objective was to analyze the international legal framework established by the UN for protecting human rights and the dignity of PDLs, as well as the contribution of existing defense mechanisms. The study was justified by the need to highlight the gaps between international regulations and their practical implementation. A qualitative approach was adopted, with a documentary and descriptive research design, utilizing the analysis of treaties, jurisprudence, and institutional reports. The population included normative documents and representative cases. Results revealed structural deficiencies and limited access to defense mechanisms. It was concluded that strengthening normative implementation and promoting dignity-based policies were essential. Recommendations included improvements in rehabilitation programs and enhanced penitentiary monitoring systems.
