Abstract

This study examines the Provisional Execution of criminal sentences, with a particular focus on the jurisprudence of the Federal Supreme Court (STF) over the years, in light of the principle of the presumption of innocence. The objective is to analyze the jurisprudential shifts and the apparent conflict between the positions established in the Direct Actions of Constitutionality (ADCs) 43, 44, and 54, and the thesis consolidated in STF Theme 1,068. To this end, the research draws on legal doctrine, academic articles, monographs, legislation, and case law. Accordingly, this paper discusses the main aspects related to the topic.
